Rationale

This is the photo of the person who died which renders obtaining a free replacement image impossible. No free image was found through the good-faith effort. The image is of sufficiently low resolution to be useless for copying. It is widely spread on the internet (see here) and in no way affects anyone's ability to make profit. Therefore, it is asserted that the usage of the picture in the WP article for the informational purposes by the non-profit WMF falls under both the FU exemption of the US copyright law as well as the narrower FU policies of the English Wikipedia.
