《德波边界条约》[a] ，为德国与波兰于1990年尾签订的一项边界条约，旨在解决德国与波兰间悬而未决的边界问题，从而满足《最终解决德国问题条约》对统一后德国的要求。该条约于1990年11月14日由波兰外长克日什托夫·斯库比舍夫斯基和德国外长汉斯-迪特里希·根舍在华沙签订，次年11月及12月26日分别获波兰议会及德国联邦议院通过，1992年1月16日正式生效。
背景
根据二战后的《波茨坦协定》，德国须将前东部领土转交波兰，并以奥得河－尼斯河线作为临时边界。此后，两德分别与苏联签订《兹戈热莱茨条约》、《莫斯科条约》[3]及《华沙条约》，对上述决定予以承认。然而，西德方面坚持须订立永久和约后，上述国界才算合法、有效[4][5]。
在1990年东德并入西德前夕，两德与四大战胜国签订《最终解决德国问题条约》，作为上述的“永久和约”。根据该条约第1章第2条规定，统一后的德国必须承认奥得河－尼斯河线[6]。因此，德国于完成统一后不久，即与波兰签订《德波边界条约》，以确立两国永久边界[7]。
内容
边界条约主要内容如下[1]：
- 重新确认按《波茨坦协定》订立之“临时边界”，乃德国与波兰间的永久边界；
- 上述边界今后不可侵犯，且两国互相尊重其主权及领土完整；
- 两国间今后不再有任何领土申索。
此外，两国另于1991年6月17日签订《德波睦邻条约》，以作为此条约的补充。
